Wings ’N More Restaurants LLC, Terms and Conditions of Use

1. Agreement to Terms

By accessing wingsnmore.com, you agree to these Terms of Service, our Privacy Policy, and all applicable laws. NOTICE: These terms contain a mandatory arbitration provision and a class action waiver.

2. Online Ordering and Pricing

  • Market Pricing: You acknowledge that chicken wing prices fluctuate based on market conditions; we reserve the right to change prices without notice.
  • Order Accuracy & Errors: We reserve the right to refuse or cancel any order. Please check your order at pickup; errors or quality issues must be reported for a replacement or credit to be issued.
  • Third-Party Delivery: Orders via providers like DoorDash or UberEats are contracts between you and that provider; we are not responsible for delays, driver conduct, or food tampering once the order leaves our premises.

3. Account & Order Management

  • User Accounts: You must be 18 or older to create an account and are responsible for maintaining the confidentiality of your login credentials.
  • Cancellations & No-Shows: Because food is prepared to order, once preparation begins, orders cannot be cancelled or refunded. If you fail to pick up an order, your card will still be charged.
  • Refunds: Approved refunds are issued to the original payment method and typically take 5–10 business days to process.
  • Termination: We reserve the right to terminate or suspend user accounts at our sole discretion for suspected fraud, misuse of the website, violation of these Terms.

4. Rewards & Loyalty Program (if applicable)

  • Program Terms: If you participate in any Wings ’N More rewards program, your usage is subject to these terms and any specific promotion rules posted at the time of offer.
  • Value & Transferability: Points, credits, or rewards have no cash value and are non-transferable.
  • Gaming the System: We reserve the right to forfeit points or terminate program access for suspected fraud or any attempt to “game” or manipulate the rewards system.
  • Expiration: Unless otherwise stated, points or rewards may expire after 24 months of account inactivity.

5. Electronic Communications (Email & Sms)

  • Consent: By providing your email address or phone number, you consent to receive order updates, receipts, and promotional marketing materials from Wings ’N More.
  • Email Opt-Out: You may unsubscribe from marketing emails at any time by clicking the “Unsubscribe” link at the bottom of our electronic communications.
  • SMS Terms: Message and data rates may apply. To opt-out of texts, reply “STOP” at any time. Consent to receive marketing communications is not a condition of any purchase.
  • Transactional Messages: Even if you opt out of marketing, you may still receive transactional emails or texts related to specific orders you place (such as order confirmations or “order ready” notifications).

6. Intellectual Property & No Scraping

  • Ownership of Content: All trademarks (including Wings ’N More®), logos, service marks, menus, text, graphics, and site architecture are the exclusive property of Wings ’N More Restaurants LLC. 
  • Limited License: You are granted a limited, non-exclusive, and non-transferable license to access and use the site for personal, non-commercial purposes such as viewing menus and placing orders. 
  • No Scraping or Automated Access: You are strictly prohibited from using “bots,” spiders, scripts, or any other automated scraping tools to crawl, harvest, or index our site for pricing, data, or content without our express written consent.
  • Trademarks: You may not use any of our trademarks or trade dress in connection with any product or service that is not ours, or in any manner that is likely to cause confusion among customers. 
  • Copyright Infringement: Any unauthorized reproduction, modification, or distribution of site content is strictly prohibited and may result in legal action.

7. Limitation Of Liability

  • Damages: To the maximum extent permitted by law, Wings ’N More Restaurants LLC shall not be liable for any indirect, incidental, or consequential damages resulting from your use of this site or consumption of our products.
  • Dietary Disclaimers & Allergens: Wings ’N More Restaurants LLC prepares food in commercial kitchens where common allergens (including but not limited to wheat, soy, milk, eggs, peanuts, tree nuts, fish, and shellfish) can be present. While we offer a variety of menu items, we cannot guarantee that any menu item is completely free of allergens due to the risk of cross-contact in shared preparation and cooking areas, including shared frying oil. Customers with severe food allergies should exercise caution.

8. Mandatory Arbitration, Class Action Waiver, & Governing Law

  • Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
  • Mandatory Arbitration: Any dispute or claim relating in any way to your use of wingsnmore.com or to any products or services sold or distributed by Wings ’N More Restaurants LLC will be resolved by binding arbitration, rather than in court.
  • Class Action Waiver: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
  • Venue: You agree that any legal action or proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Brazos or Travis County, Texas.

9. Prohibited User Conduct

You agree not to use wingsnmore.com for any unlawful purpose or in any way that could damage, disable, or impair the site. Specifically, you are prohibited from:

  • Malicious Activity: Uploading or transmitting viruses, worms, Trojan horses, or any other malicious code.
  • Unauthorized Access: Attempting to gain unauthorized access to our computer systems, user accounts, or customer databases.
  • Interference: Using any device or software to interfere with the proper working of the online ordering system or any transaction being conducted on the site.
  • Harassment: Using the site or any integrated contact forms to harass, abuse, insult, harm, defame, or intimidate our staff or other users.
  • Fraudulent Orders: Placing “fake” orders or providing false information to manipulate our rewards program or inventory.
  • Circumvention: Bypassing or attempting to bypass any security features or content-filtering technologies we employ.

10. Disclaimer Of Warranties (“As Is”)

The site and all content, functions, and services made available through the site are provided on an “as is” and “as available” basis. Wings ’N More Restaurants LLC does not warrant that the site or the services, content, or functions made available thereby will be timely, secure, uninterrupted, or error-free, or that defects will be corrected. We make no warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement, merchantability, or fitness for a particular purpose.

Our site may contain links to third-party websites or services (such as Facebook, Instagram, or Google Maps) that are not owned or controlled by Wings ’N More Restaurants LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Wings ’N More Restaurants LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such third-party content or services.

12. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. The most current version will always be posted on wingsnmore.com with the “Effective Date” updated accordingly. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the site.
